Terms & Conditions
Effective date: 2026-07-01
1. Acceptance of Terms
By accessing or using the Yacht Social platform — including our website, mobile applications, and any related services (collectively, the "Platform") — you agree to be bound by these Terms and Conditions ("Terms") and our Privacy Policy. If you do not agree, you may not use the Platform.
These Terms constitute a legally binding agreement between you and Yacht Social Ltd ("Yacht Social", "we", "us", or "our"). We may update these Terms from time to time. Continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.
2. The Platform
Yacht Social is an online marketplace that connects individuals and businesses who wish to list private vessels for charter ("Owners" or "Hosts") with individuals who wish to rent or charter those vessels ("Renters" or "Charterers"). Yacht Social is not a yacht owner, charter company, or maritime operator.
We do not own, operate, manage, or control any vessel listed on the Platform. We are not a party to any charter agreement between an Owner and a Renter. Any such agreement is solely between the Owner and the Renter, and Yacht Social bears no liability for its performance.
Yacht Social facilitates bookings and payments as a limited payment collection agent on behalf of Owners. This does not make Yacht Social a party to any charter transaction.
3. Accounts & Eligibility
To access most features of the Platform you must create an account. You must be at least 18 years old and legally capable of entering into binding contracts in your jurisdiction. By creating an account you represent and warrant that this is the case.
You agree to provide accurate, current, and complete information and to keep your account details up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@yachtsocial.app if you believe your account has been compromised.
We reserve the right to suspend or terminate any account at our sole discretion, including where we believe a user has violated these Terms, provided false information, or poses a risk to other users or to Yacht Social.
4. Vessel Owners
To list a vessel you must complete our owner verification process and agree to our Host policies. By listing a vessel you represent and warrant that:
- You own the vessel or have full authority to offer it for charter.
- The vessel holds all required registration, safety certification, and insurance mandated by the jurisdiction in which it operates.
- Your listing is accurate and does not misrepresent the vessel's condition, specifications, or availability.
- You will honour confirmed bookings except in documented cases of force majeure or legitimate safety concerns.
Yacht Social charges a service commission on each completed booking. The current commission rate is disclosed in your Owner dashboard and may be updated with 30 days' notice. Payouts are processed within 5–7 business days of a completed charter, subject to our payout schedule.
Contact information: You may not request or use a Renter's contact information (email, phone number, or any other personal data) for any purpose other than fulfilling the confirmed charter. You may not use such information to solicit future bookings outside the Yacht Social Platform.
5. Renters & Charterers
By making a booking request you confirm that you and all passengers will comply with the Owner's house rules, applicable maritime law, and all safety requirements. You are responsible for the conduct of all guests aboard the vessel.
You must not use the vessel for any unlawful purpose, exceed the stated passenger capacity, or operate the vessel while under the influence of alcohol or controlled substances. Damage caused by misuse, negligence, or failure to follow the Owner's instructions is your sole financial responsibility.
Yacht Social is not responsible for the acts or omissions of Owners or vessels. You charter entirely at your own risk and are strongly encouraged to obtain appropriate travel and charter insurance.
6. Bookings & Payments
A booking is initiated when a Renter submits a booking request. No charter agreement is formed until the Owner explicitly confirms the booking through the Platform. We will notify both parties of the confirmed status by in-app notification.
All prices are displayed in USD. Additional taxes, port fees, fuel surcharges, provisioning, and crew gratuity may apply and are the sole responsibility of the Renter unless explicitly stated as included in the listing.
Payments are processed by our third-party payment processors. By providing payment details you authorise us to charge the full charter amount plus any applicable fees at the time of booking confirmation. Yacht Social does not store full card details on its servers.
Split payments: Yacht Social offers an optional split-payment feature allowing multiple users to each contribute a portion of a charter cost. Each participant's obligation is limited to their stated share. If any participant fails to complete their payment, the remaining participants and the Organiser are not liable for that shortfall. Yacht Social reserves the right to cancel an unfully-funded split booking after 72 hours.
7. Cancellation & Refunds
Cancellation and refund rights depend on the Owner's selected cancellation policy, which is displayed on every listing before you book:
- Flexible: Full refund if cancelled at least 5 days before the charter start date.
- Moderate: Full refund if cancelled at least 14 days before start; 50% refund thereafter.
- Strict: 50% refund if cancelled at least 30 days before start; no refund thereafter.
All refunds are returned to the original payment method and may take 5–10 business days to appear depending on your bank. Yacht Social's service fee is non-refundable except where Yacht Social is responsible for the cancellation.
If an Owner cancels a confirmed booking, the Renter will receive a full refund including the service fee. Owners who repeatedly cancel confirmed bookings may have their listings suspended.
8. Prohibited Conduct
You agree not to:
- Circumvent the Yacht Social Platform to arrange charters directly with Owners or Renters met on the Platform ("off-platform transactions").
- Create fake reviews, manipulate ratings, or misrepresent your identity or affiliation.
- Harvest other users' personal data or contact information for marketing or solicitation purposes.
- Use the Platform to facilitate illegal activities, including unlicensed charter operations.
- Upload content that is defamatory, discriminatory, obscene, or infringes third-party intellectual property rights.
- Attempt to gain unauthorised access to any part of the Platform or any other user's account.
Violations may result in immediate account termination, forfeiture of outstanding payouts, and legal action where appropriate.
9. Contact Information & Privacy
Yacht Social treats the protection of user contact information as a core platform principle. Vessel Owners are granted access to a Renter's contact details (email address and phone number, if provided) only after a booking has been confirmed. Prior to confirmation, all communication between Owners and prospective Renters must take place through Yacht Social's in-app messaging system.
Renters' personal data is processed in accordance with our Privacy Policy. Owners who receive Renter contact details following booking confirmation must not:
- Use that information to market other products or services.
- Share it with third parties other than crew members who need it to fulfil the charter.
- Retain it after the charter has been completed beyond any period required by law.
Breach of these obligations constitutes a material violation of these Terms and may result in immediate account termination and civil liability.
10. Liability & Disclaimers
The Platform is provided "as is" and "as available". Yacht Social makes no representations or warranties, express or implied, regarding the accuracy of listings, the suitability of vessels, the conduct of Owners or Renters, or the safety of any charter.
To the maximum extent permitted by applicable law, Yacht Social's aggregate liability to you for any claim arising out of or related to the Platform shall not exceed the greater of (a) the total Yacht Social service fees you paid in the 12 months preceding the claim, or (b) USD 500.
Yacht Social shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, even if advised of the possibility of such damages.
11. Disputes & Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or related to these Terms or the Platform shall first be submitted to good-faith negotiation. If unresolved within 30 days, disputes shall be referred to binding arbitration under the rules of the London Court of International Arbitration (LCIA).
You and Yacht Social both waive the right to a jury trial and the right to participate in class actions. Nothing in this clause prevents either party from seeking emergency injunctive relief from a court of competent jurisdiction.
12. Changes to These Terms
We may modify these Terms at any time. We will provide at least 14 days' notice of material changes by email and/or a prominent notice on the Platform. Your continued use of the Platform following the effective date of changes constitutes your acceptance of the revised Terms.
